The plaintiff was attempting to cross N. W. Front avenue, a public street in the city of Portland, when he was struck by a taxicab owned by the defendants Royce, and operated by the defendant Jan J. Angelos. At the close of the plaintiffs evidence in the trial court the defendants moved for a judgment of involuntary nonsuit, which motion the trial court granted. Subsequently the plaintiff moved that the judgment of involuntary nonsuit be set aside and a new trial granted, which motion was allowed. From this ruling granting a new trial the defendants have appealed.
